(From Shearman & Sterling) – Attached please find Shearman & Sterling’s latest client publication, summarizing the long-awaited guidance on the U.S. Foreign Corrupt Practices Act (FCPA) published this week by the U.S. Department of Justice and the Securities and Exchange Commission.
Although the Guide does not set out any new policy positions by the DOJ or SEC, it provides helpful guidance regarding anti-corruption compliance programs and the DOJ’s and SEC’s enforcement policies, as well some warnings of certain aggressive positions being taken by the government.
